   Construction Site Runoff Control       ("Rule 5")

 
Construction site runoff is a potential source of pollutants when it rains.  The most likely pollutant is sediment – soil that washes off disturbed ground at a construction site.  For that reason, local ordinances now require submittal of a Storm Water Pollution Prevention Plan (SWPPP) and implementation of erosion and sediment control measures on construction sites disturbing one acre of soil or more.   
For all construction in Elkhart County , the Elkhart County SWCD is the agency named by local and state rules to review the SWPPP.  
The submittal to the SWCD must include:
1)  The Stormwater Clearance Application
2)   The SWPPP
- This Checklist is what the SWCD uses to review plans; all required items are included in the  checklist.

- This Guidance Document provides instructions for fulfilling the requirements of each item on the checklist.

- A filing fee of $100 per disturbed acre or fraction of an acre (all areas except Nappanee)
Note:  It is up to the plan preparer to calculate the disturbed acreage.  Disturbed acreage should include all land disturbed for roads, utilities, stormwater retention or detention, and development on individual lots that are included in the plan.  For each lot in a residential subdivision, the state assumes ½-acre of land disturbance OR the total lot size if the lot is smaller than a half acre.  Plan preparers should assume the same amount of disturbance unless it can be proven otherwise. After submittal, the SWCD has 28 days to review the plans.  Once a plan review is complete, showing the plan to be adequate, the owner must submit a Notice of Intent (NOI) to IDEM, along with a $100 fee and proof of publication in a local newspaper.  Construction may begin 48 hours after the postmarked date of the NOI.   Also required of the developer/permittee is the posting of the Notice of Intent (NOI) on-site with the location of the Stormwater Pollution Prevention Plan (SWPPP) and the contact person(s) for viewing the SWPPP and the weekly inspection reports.

If construction is not finished by December 31 of the second year of site work, the owner must submit a renewal application to the SWCD.  A complete SWPPP is not required, but a filing fee of $100 is required.

According to Federal, State, and local regulations, a site  developer/permittee is required to conduct site inspections a minimum of:

- Once a week, AND

- By the end of the next business day, after each ½” storm event until the  Notice of Termination (NOT) is filed and approved. These inspection reports must be available within 48 hours upon request by an inspecting authority (Town, City, County, SWCD, State, or Federal).

A SWPPP construction site self inspection report (cover page and inspection form) has been adapted from an EPA document by the Greater Elkhart County Stormwater Partnership for every developer / permittee to use.

Local inspecting authorities in Elkhart County WILL be requesting copies of your self inspection reports when reviewing your site for a complaint or during routine inspections.

This SWPPP Construction Self Site Inspection Report Example is for a commercial or industrial site but can be easily adapted to a residential site. When all construction is finished and the site is stable, the owner must submit a Notice of Termination (NOT) to the SWCD.   The SWCD will visit the site one last time, and if it is stable, will send the NOT to IDEM. Site inspections must be continued until the approved NOT form is received by the developer / permittee.
